In these Terms and Conditions, “Imani Glow”, “we”, “us” and “our” refer to SOKO IMANI (PTY) LTD. “You” and “customer” refer to anyone who visits our website or purchases from us.

2. Acceptance of these Terms

By accessing our website, creating an account or placing an order, you agree to these Terms and Conditions and the policies referenced within them.

If you do not agree to these Terms, you should not use our website or place an order.

Our store is hosted by Shopify, which provides the e-commerce platform used to sell our products. Your purchase agreement is with SOKO IMANI (PTY) LTD trading as Imani Glow, not with Shopify.

3. Customer information

You agree to provide accurate, current and complete information when placing an order. This includes your name, contact details, delivery address and payment information.

We will not be responsible for delivery delays or additional costs resulting from incorrect or incomplete information supplied by the customer.

You are responsible for protecting your account password and restricting access to your account.

Customers under the age of 18 must have permission from a parent or legal guardian before placing an order.

4. Products and availability

We make reasonable efforts to display product descriptions, ingredients, sizes, colours, packaging and photographs accurately.

Colours may appear differently depending on the device or screen being used. Manufacturers may also update product packaging from time to time without changing the product itself.

We will disclose any material differences that affect the product’s nature, ingredients, quantity or intended use where reasonably possible.

All products are subject to availability. If an ordered product becomes unavailable, we will contact you and offer a refund or an alternative product. You will not be required to accept an alternative product.

5. Skincare and health information

The skincare information on our website is provided for general informational purposes only. It is not medical advice and should not be used to diagnose, treat, cure or prevent a medical condition.

Skincare results differ from person to person. We do not guarantee that a product will produce identical results for every customer.

Customers should:

• Review the ingredients before using a product;

• Follow the product instructions;

• Perform a patch test before full use; and

• Consult a qualified healthcare professional if they have allergies, sensitive skin or an existing medical condition.

Stop using the product and seek appropriate medical advice if you experience a serious or persistent reaction.

Nothing in this section limits your rights if a product is unsafe, defective, expired, incorrectly labelled or materially different from its description.

6. Prices and payments

All prices are displayed in South African rand unless otherwise stated.

Applicable delivery charges and other costs will be displayed before you complete checkout. You will have an opportunity to review and correct your order before making payment.

Payment must be successfully authorised before an order can be processed.

We reserve the right to correct genuine pricing or product-information errors. If an error affects an order you have already placed, we will contact you and allow you to accept the corrected information or cancel the affected order for a full refund.

7. Orders

After placing an order, you should receive an order-confirmation email. This confirms that we have received your order.

We may reasonably cancel or limit an order where:

• The product is unavailable;

• Payment cannot be authorised;

• Incorrect customer information was supplied;

• The order appears fraudulent or unlawful;

• A genuine pricing or listing error occurred; or

• We cannot legally supply the product.

If we cancel an order after receiving payment, we will issue a refund through the original payment method.

8. Shipping and delivery

Shipping and delivery information is provided in our Shipping Policy.

Delivery times displayed on our website are estimates unless we expressly agree to a particular delivery date.

Customers are responsible for providing a complete and accurate delivery address. Please contact us immediately if you notice an error in your delivery information.

Goods remain our responsibility until they have been delivered and accepted, as required by applicable law.

If we cannot fulfil your order within the agreed or legally required period, we will notify you. You may be entitled to cancel the order and receive a refund.

9. Cancellations, returns and refunds

Cancellations, returns and refunds are handled according to our Return and Refund Policy and applicable South African consumer law.

For eligible change-of-mind returns, customers should contact us within seven days of receiving the order. The product must be unopened, unused, sealed and in its original condition and packaging.

Opened or used skincare products generally cannot be returned solely because the customer changed their mind, due to health and hygiene considerations.

This restriction does not remove your legal rights relating to products that are:

• Damaged;

• Defective or unsafe;

• Expired;

• Incorrectly supplied;

• Incorrectly described; or

• Not reasonably suitable for their intended purpose.

Qualifying defective or unsafe products may be returned within six months of delivery in accordance with the Consumer Protection Act.

Before returning a product, contact Sokoimaniholdings@gmail.com for approval, instructions and the correct return address.

10. Promotions and discount codes

Promotional offers and discount codes may be subject to additional conditions, expiry dates and availability restrictions.

Unless otherwise stated:

• Discount codes cannot be exchanged for cash;

• Only one discount code may be used per order;

• Discounts cannot be applied retrospectively; and

• Promotions remain subject to product availability.

Promotional terms do not remove any rights provided under South African consumer law.

11. Intellectual property

The Imani Glow name, branding, website design, written content, graphics and original images belong to SOKO IMANI (PTY) LTD or are used with permission.

You may not copy, reproduce, distribute, sell, modify or commercially exploit our content without prior written permission.

You may use our website and content for personal, non-commercial shopping purposes.

12. Prohibited activities

You may not use our website:

• For an unlawful or fraudulent purpose;

• To provide false or misleading information;

• To impersonate another person;

• To transmit viruses or malicious code;

• To interfere with the website’s operation or security;

• To collect another person’s information without permission;

• To attempt unauthorised access to an account or system; or

• To copy or exploit our content for commercial purposes without permission.

We may restrict access or cancel an order where we reasonably believe that unlawful, fraudulent or abusive activity has occurred.

13. Third-party services and links

Our website may use third-party services, including Shopify, payment providers, delivery companies and analytics providers.

External websites and services may have their own terms and privacy practices. We are not responsible for content or activities on unrelated third-party websites.

Using third-party providers does not remove Imani Glow’s legal obligations to its customers.

14. Personal information and privacy

We process personal information according to our Privacy Policy and applicable South African data-protection laws.

By placing an order, you authorise us and the service providers necessary to complete the transaction to process information for purposes including:

• Processing payment;

• Fulfilling and delivering your order;

• Preventing fraud;

• Communicating with you; and

• Providing customer support.

Marketing messages will only be sent where permitted, and you may unsubscribe from marketing communications.

15. Limitation of liability

To the fullest extent permitted by law, Imani Glow will not be responsible for indirect or consequential losses that were not reasonably foreseeable.

We are not responsible for harm caused by deliberately misusing a product, ignoring clear product instructions or using a product after becoming aware of a known personal allergy.

Nothing in these Terms excludes or limits liability that cannot legally be excluded. These Terms do not remove or reduce your rights under the Consumer Protection Act, the Electronic Communications and Transactions Act or any other applicable South African law.

16. Suspension or termination

We may suspend or terminate access to our website where a person engages in fraudulent, abusive, unlawful or harmful activity.

Termination will not affect rights and obligations arising from orders that were validly placed before termination.

17. Changes to these Terms

We may update these Terms when our services, business practices or legal obligations change.

Updated Terms will be published on our website with a revised effective date. Changes will not unfairly remove rights that applied to an order placed before the change.

18. Severability and waiver

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

If we do not immediately enforce a provision of these Terms, this does not mean that we have permanently waived that provision or any related right.

19. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa.

We encourage customers to contact us first so that we can attempt to resolve complaints fairly and promptly.

Nothing in these Terms prevents a customer from approaching the National Consumer Commission, a consumer-protection body, an appropriate tribunal or a court with jurisdiction.
